About ten years ago, Maria Jose Blanco Barea was working as a lawyer having a great future. She had dreams, strength, health, economic independence and resources. Then she got pregnant and the first symptoms of Parkinson appeared, but at the beginning, the soft signs of the illness did not make her change her mind about becoming a mother and having her child. Under these circumstances, Maria Jose’s mate and biological father of her child, soon disappeared leaving her and the baby in an absolute social, emotional and economic defenselessness.

The quick evolution of Maria Jose’s illness made her take sick leave causing her a great pain for having to quit from her profession and for becoming poor, having to ask for help from her family and friends to continue providing care and wellbeing for her child.

Fortunately, Javier appeared in their lives and they all became a family. Javier had no problem in sharing his life with a woman with Parkinson, with a small child and with no economic resources. He has demonstrated to be generous and committed to his mate and new family, giving them all what he had. Javier is a father for this child.

This can be summarized in a mother who renounces to her work and incomes, but who looks for strategies to give stability, wellbeing and love to her child.

In addition to her health problems, the biological father of the boy, who was 4 years old at that time, requested to visit the kid and to exercise his parenthood. By that time, Maria Jose, her husband (Javier) and the kid were already a family.

Each parent started to claim the right for what they considered most adequate, either in defense of their rights or on behalf of the child’s right.

With the purpose of defending their positions both visited psychologists, psychiatrists, social workers and tribunals. There have been claims, resources, investigations, appeals and even the manipulative influence of, the pretended but not less damaging at this time, PAS (Parental Alienation Syndrome).


After 6 years of legal battles, the current balance of this process is as follows:

-The biological mother, Maria Jose, is in prison.
-The biological father has custody of the child, while the mother is serving a sentence.
-Maria Jose’s husband has his mate in prison and cannot see or have any contact with the kid.
-The child, who is far away from his home:

• Cannot see the persons to whom he is bounded (his mother and her husband).
• Has moved to another city.
• Has changed his daily life style.
• Has to move to another school
• Has left his family, friends and schoolmates.
• Even the weather and idiosyncrasy of the new place is different.

Isn’t this too much uprooting for a small child?
How much insecurity, fear and suffering is he going through?

This is too much loss for a 9 year old kid.

-He knows that his mother is sick and in prison.
-He might make his biological father responsible for his mother being in prison. He might even blame his biological father for anything bad that might happen to him.

This “misunderstanding” between adults might have lead to:

-Direct suffering of the persons implied in the conflict.
-Uprooting of a kid from its family, home, school and friends.
-A woman who has to fight minute-to-minute with the fateful symptoms of Parkinson in prison, and, far away from her child (reason of her life, making her fight every day with her illness.)


Maria Jose Blanco has been condemned to Parkinson for years, she does not need bars or chains. Every person has a limit and she needs a warm, loving, and harmonic environment and a dream to be able to support or attenuate her symptoms.

The present situation does not benefit any of the parties, it only increases ill will from one to another, even resentment from the child to his biological father.

It is imperative to be rational, comprehensive and human for this case to stop causing so much pain, and to impede irreversible results for the child, for Javier, Maria Jose and even for the biological father of the child.

It is necessary that Maria Jose Blanco Barea, leaves prison immediately.


For the above mentioned, and because of her health situation, we request:

A. A full amnesty from all penalties given to Maria Jose Blanco Barea because of judicial disobedience to the different cases related to the Paternal Authority assignment of her child.

B. In any case, and urgently, we request her freedom in change for home sentence because of her illness, which is protected by WHO provisions, and because of not having a self-protection relief.
